Web Design Agreement
This Agreement is made between Digital Business Host (DBH), herein referred to as “Designer”, and the undersigned Client, collectively referred to as “Parties”.
1. Project Scope
DBH agrees to design and develop a professional website for the Client based on the features and specifications discussed. The scope includes:
Website layout and structure
Design implementation
Mobile optimization
SEO-ready build
Basic content placement (provided by the Client)
E-commerce functionality (if applicable)
2. Hosting
The Client agrees to be hosted on DBH’s shared hosting environment unless a separate hosting arrangement is requested and paid for.
DBH ensures uptime, domain setup, and technical support related to the hosting.
If the Client decides to migrate hosting, DBH will provide files but is not responsible for migration or support on third-party hosts.
3. Plugins & Licenses
DBH will install and activate standard plugins necessary for the website’s function.
DBH will cover the cost of premium plugins for the first year only.
After the first year, the Client is responsible for renewing or replacing premium plugins if desired.
DBH will advise on which plugins are critical, but continued functionality or updates of premium plugins beyond the first year is not guaranteed unless renewed by the Client.
4. Content Responsibilities
The Client is fully responsible for supplying all website content, including text, images, videos, and pricing details.
DBH will provide placeholders or minimal copywriting guidance, but full content creation is not included in this agreement.
Delays in content delivery may affect project timelines.
5. E-Commerce Store Terms (If applicable)
DBH will build a functional e-commerce platform using WordPress and WooCommerce or another agreed system.
Setup includes product pages, shopping cart, checkout, payment gateway integration (e.g. Payfast).
DBH will install and configure up to the number of products agreed upon.
Product images, descriptions, and pricing must be supplied by the Client.
DBH is not responsible for:
Managing product stock or orders post-launch
Payment disputes between the Client and their customers
Ensuring payment gateway approval or merchant account setup
Handling shipping integrations unless specified
6. Timeline & Revisions
Project start and estimated delivery dates will be confirmed after initial deposit.
The Client is entitled to two rounds of design revisions. Additional revisions may incur an added cost.
7. Payment Terms
A 50% deposit is required to begin work.
Final payment is due upon project completion and before the site goes live.
No work will be handed over until full payment is received.
8. Ongoing Support & Maintenance
This agreement does not include ongoing maintenance or support unless a separate maintenance contract is signed.
DBH offers support packages at an additional monthly or annual fee.
9. Termination
Either party may terminate this agreement with written notice.
In case of termination before completion, DBH retains all work completed and the Client forfeits the deposit.
10. Legal
This agreement is governed by the laws of the Republic of South Africa.
DBH retains the right to display the website as part of its portfolio.
